Terms and conditions

§ 1 General provisions

1.1 The Internet Shop is available at www.watchmark.pl and is run by Ampliton Specjalistyczne Gabinety Protetyki Słuchu Grzegorz Dubrowski, ul. II Armii Wojska Polskiego 32, Witoszyn, 68 – 131 Wymiarki, NIP 924 133 98 68, REGON 080290725, ul. 1.2 The Watchmark shop conducts retail sales via the Internet. Orders are accepted through the website www.watchmark.pl.

1.3 The Customer is entitled and obliged to use the Internet Shop in accordance with its purpose. It is forbidden to introduce unlawful content.

1.4 The definitions used in the Regulations shall mean:

a) the Internet Shop, referred to as the “Shop”. – Watchmark, run by Ampliton Grzegorz Dubrowski, which accepts orders at www.watchmark.pl.

b) Customer – a natural person, legal person or organisational unit using the Internet Shop, in particular making purchases

c) Rules and Regulations – the following regulations, which define the rules of making purchases in the Store

d) Product, referred to as “Item” – a movable thing available in the Internet Shop, which is the subject of a Sales Agreement between the Customer and the Shop.

§ 2 Services provided by the Shop

2.1 The On-line Shop provides the following services:

a) enabling the purchase of Products offered by the Shop through an order form

b) maintaining a Customer Account with the Store – agreement concluded for an indefinite period of time

c) enabling Customers to express their opinions on Store Products

d) providing marketing and commercial information electronically – Newsletter

2.2 The Customer may terminate the agreement for provision of a Customer Account at any time, without giving reasons and without bearing the costs, by sending an e-mail to info@ampliton.pl or in writing to AMPLITON Grzegorz Dubrowski, ul. II Armii Wojska Polskiego 32, Witoszyn, 68-131 Wymiarki, requesting removal of the Customer Account together with indication of the e-mail address currently registered with the Store.

§ 3 Terms of service

3.1 The Customer can register an individual account by filling in a registration form, providing the following data: name, surname, telephone, e-mail.

3.2 The Customer can use the Shop without registering an account. When placing an order, the Customer who does not have a registered account, gives in the form the necessary data for the delivery of the ordered Products.

3.3 The information available on the Shop website is an invitation to conclude a contract.

3.4 The prices of the Products shown on the site in Polish zloty are gross prices, including VAT.

3.5 The cost of delivery shall be added to the product price, the amount of which shall depend on the chosen delivery option and payment method. The price given on the website at the moment of order placement is the final price binding for the Customer. Once the order has been placed, the price of the ordered goods cannot be changed.

3.6 Orders are delivered by a courier company chosen by the Customer.

3.7 The costs are indicated during the order placement process and are dependent on the order value, weight and dimensions of the parcel before the order is confirmed.

§ 4 Shopping at the Shop

4.1 Orders can be placed 24 hours a day, 7 days a week.

4.2 In order to place an order, you need to put the chosen Product in the basket, then choose the type of shipment and method of payment, then confirm the order

4.3 An order confirmation message will be sent to your e-mail address.

4.4 Placing an order by the Customer means placing an offer to conclude a sales agreement (purchase) of the ordered Product.


§ 5 Method and date of payment

5.1 The Buyer is obliged to pay the Total Price + Shipment Cost for the purchased Product no later than within 72 hours from the date of placing an order.

5.2 The payment shall be made by means of payment methods accepted and offered by the Administrator:

a) Cash on delivery – payment is made to the courier upon receipt of the courier’s delivery,

b) Standard transfer,

c) Transfer via fast payments – Tpay,

d) PayNow electronic payment

§ 6 Withdrawal from the contract

6.1 The Customer has the right to withdraw from this contract within 14 days without giving any reason.

6.2 The period to withdraw from the contract expires 14 days from the day following the day on which the Customer received the item.

6.3 The Customer shall inform the Store about the withdrawal from a contract by filling in a form. After registering the withdrawal from a contract form, the Customer shall receive a confirmation of its notification to the indicated e-mail address, together with a pdf attachment containing a summary together with the barcode. To meet the withdrawal deadline, it is sufficient for the Customer to send information concerning the exercise of his/her right of withdrawal before the expiry of the withdrawal period.

6.4 The Customer shall send the purchased goods himself to the address specified in the form. The package must be accompanied by the purchased goods free of defects, a summary with the barcode generated when completing the form and proof of purchase.

6.5 Reimbursement shall be made using the same means of payment as those used by the Customer in the original transaction, unless the Customer has expressly agreed otherwise; within 14 working days from the date of withdrawal.

6.6 The Consumer shall be liable for any diminution in the value of the item resulting from the use of the item beyond what is necessary to establish the nature, characteristics and functioning of the item.


§ 7 Product complaints

7.1 Any Product purchased from the Shop can be complained about.

7.2 Complaints should be sent to the following address: Watchmark CH Manhattan, al. Jana Pawła II 16, 64-100 Leszno. In order to make a complaint, please fill in the form. After registering the complaint, you will receive a confirmation of its submission to the specified e-mail address along with a pdf attachment, which includes a summary of the complaint with the barcode. The complaint must be accompanied by the advertised Product with proof of purchase and a summary with the barcode generated when filling in the form.

7.3 The complaint will be considered within 30 days of its submission.


§ 8 Complaints about the functioning of the Shop

8.1 The Customer may also submit complaints regarding the functioning of the Store and provision of services electronically or by registered mail to the following address: Ampliton Grzegorz Dubrowski, Watchmark CH Manhattan, al. Jana Pawła II 16, 64-100 Leszno. In the text of the notification, the reason for the complaint and details of the complainant (name, surname, address, telephone) shall be indicated.

8.2 The complaint shall be considered within 30 days of its filing.


§ 9 Personal data protection

9.1 The Customer’s consent for Ampliton Grzegorz Dubrowski to process personal data within the meaning of the Personal Data Protection Act of August 29th, 1997 (i.e. Journal of Laws of 2002 No. 101, item 926 as amended) is voluntary, however, lack of consent for the processing of personal data shall make it impossible to execute the agreement and carry out the order.

9.2 The Customer may consent to the processing for marketing purposes of his/her personal data within the meaning of the Personal Data Protection Act of 29 August 1997 (i.e. of 2002, Journal of Laws No. 101, item 926, as amended) and their entrusting to a third party for the purpose of providing the Customer with advertising materials and information on promotional and marketing actions and running an online shop.

9.3 The administrator of the personal data is Ampliton Specjalistyczne Gabinety Protetyki Słuchu Grzegorz Dubrowski, ul. II Armii Wojska Polskiego 32, Witoszyn, 68 – 131 Wymiarki, NIP 924 133 98 68, REGON 080290725.


§ 10 Final provisions

10.1 In matters not covered by these Terms and Conditions, the generally applicable provisions of Polish law shall apply, in particular the Civil Code and the provisions of the Consumer Rights Act of 30 May 2014( Journal of Laws 2014, item 827)

10.2 The Entrepreneur is obliged to deliver the Products without defects.

10.3 The shop is not responsible for incorrect data provided by the Customer.

10.4 The Shop reserves the right to change the Terms and Conditions without giving any reason for the changes. The Users will be informed about the introduced changes.

10.5 The Regulations come into force on 12.07.2021.
